um, perhaps I missed some of the history of the case, but isn't it the point that the patient is incompetent to decide?

Nah; it makes all kinds of sense. The "then" quotations advocate serious medical decisions being made by physicians and patients (not just by patients, by the way). The "now" quotations advocate serious medical decisions being made by Congress or by "all of us". It's a long way from "the patient is incompetent to decide" to concluding that the Congress ought to be able to decide.
